Terms of Service

These Terms of Service ("Terms") govern access to and use of SnapRace's website, applications, and related services (collectively, the "Service") by race organizers, photographers, participants, and other visitors. By accessing or using the Service, you agree to these Terms.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. If you are a participant or visitor, these Terms apply to your use of event pages, photo search tools, downloads, and other participant-facing features.

SnapRace is a race photo discovery, publishing, and management platform that provides:

Organizer features require an account authenticated through one of our supported sign-in providers. You are responsible for safeguarding account credentials and for actions taken through your account, including actions by your team members or invited users.

You agree to provide accurate account, organization, billing, and event information, and to ensure that only authorized users access organizer tools under your account or organization.

We may suspend, restrict, or terminate accounts that violate these Terms, create security or legal risk, abuse the Service, or remain inactive for an extended period.

As a Race Organizer using our Service, you agree to:

• Only upload photos, results, participant data, and other materials for events you are authorized to manage.
• Obtain and maintain all rights, notices, waivers, and consents required to collect, use, and share event photos, participant data, and any biometric or facial-recognition-related data under applicable law.
• Ensure that participant data you provide, including names, bib numbers, and timing data, is accurate and that you have the lawful right to share it with SnapRace.
• Comply with all applicable laws, regulations, and industry requirements, including privacy, data protection, consumer protection, publicity-rights, and intellectual-property laws.
• Promptly cooperate with reasonable requests relating to takedowns, corrections, participant notices, deletion requests, or regulatory inquiries tied to your event content or data.
• Remain solely responsible for your event operations, registration terms, participant refunds, race-day safety, and claims arising from the event itself rather than from the Service.

Participants generally may access event galleries, race results, and related event pages without creating a SnapRace account. If you upload a selfie or otherwise use a facial-matching feature, you authorize the processing described in our Privacy Policy and any event-specific consent flow presented to you.

Unless expressly stated otherwise, participants may download and share their own race photos only for personal, non-commercial use. You may not resell photos, use them for advertising, train AI models on them, or otherwise exploit them commercially without permission from the applicable rights holder.

Event-specific rules, participant eligibility, timing data, result corrections, photo visibility, and media availability may be controlled by the Race Organizer. SnapRace is not responsible for an Organizer's race administration decisions or event policies.

SnapRace operates on a pay-per-event model for organizers. Fees may vary by currency, participant count, included photo allowance, excess photos, promotional credits, taxes, and other pricing details disclosed on the Service at the time of purchase.

Organizer charges are generally due when an event is published. If additional photos are uploaded or committed after initial publication, additional charges may apply based on the pricing in effect for that event and currency.

We may offer credits, discounts, or pilot promotions. Such promotions are subject to their stated terms, may be limited in scope or duration, and may be revoked for misuse. We may also introduce storage- or file-size-based charges in the future if separately disclosed before they are charged.

Except as required by applicable law or expressly stated otherwise, fees are non-refundable. Organizers are responsible for applicable taxes and for complying with the terms of any third-party payment processor used to complete a transaction.

The Service, including its software, interface, trademarks, workflows, and underlying technology such as AI tagging, bib recognition, and facial-matching systems, is owned by SnapRace or its licensors and is protected by intellectual-property and other laws.

Race Organizers, photographers, and other uploaders retain ownership of the content they submit, subject to any rights they grant to others. By uploading content to SnapRace, you grant us a limited, non-exclusive license to host, store, reproduce, process, adapt, display, and distribute that content as necessary to operate, secure, support, and improve the Service and comply with law.

Participants receive only a limited, revocable, non-transferable right to access and use the Service for its intended purpose. You may not copy, modify, resell, scrape at scale, distribute, or reverse-engineer the Service except as expressly permitted by law.

We may remove content, disable access, limit features, or suspend accounts if we reasonably believe doing so is necessary to enforce these Terms, respond to rights claims, protect users, comply with law, or mitigate security, privacy, or reputational risk.

If you believe content on the Service infringes your copyright, privacy, publicity, or other rights, contact us at snaprace.info@gmail.com with sufficient detail for us to investigate and respond.

To the maximum extent permitted by applicable law, SnapRace will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or event-related losses arising out of or relating to the Service.

To the maximum extent permitted by applicable law, SnapRace's total liability for claims arising out of or relating to these Terms or the Service will not exceed: (a) for organizers, the amount paid by you to SnapRace during the twelve (12) months before the event giving rise to the claim; or (b) for participants and other users who paid SnapRace no fee, USD 100 or the equivalent amount in local currency.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including any mandatory consumer rights or non-waivable statutory protections.

You may stop using the Service at any time. Organizers may request deletion of an account or organization through available account tools or by contacting us. Deletion may remove events, photos, billing records, memberships, and related content, subject to legal, security, audit, backup, and billing-retention requirements.

We may suspend or terminate access to the Service, remove content, or limit features at any time if we believe you violated these Terms, created legal or security risk, failed to pay applicable fees, or used the Service in a manner harmful to us or others.

Upon termination, rights granted to you under these Terms end immediately, but provisions that by their nature should survive termination will remain in effect, including payment obligations, intellectual-property provisions, disclaimers, limitations of liability, indemnification, and dispute-related provisions.
